論保險監理之基本架構-兼論我國保險監理制度之改進

為求實現政治、經濟或社會方面上之政策目標,保險監理必須經由不同機構予以實施,藉此將監理目標轉化為可實現之原理及規則。因此,如何在不同之監理機構間針對資源與權責作架構上之配置,以協助達成監理目標,乃保險監理之一項重要課題。本文根據政治力量說(political theory)之基本論點,分別探究政府組織之立法、行政與司法等部門實施保險監理時之應有職責、特色與優劣,並介紹保險業實施自我監理之成例與利弊。最後,筆者針對我國保險監理架構之現況提出改進建議,藉此提供相關單位日後進行保險監理革新時之參考。

A Study on Structure of Insurance Regulation: Suggestions for Insurance Regulatory Reform in Taiwan

To achieve regulatory policies in political, economic and social aspects, regulatory objectives need to be transformed into practical principles, standards or guideline by regulators. Under such a scenario, it is important to allocate resources and responsibility among different kinds of regulatory sectors with a comprehensive regulatory structure. This paper adopts the fundamental argument addressed in the Political Theory to explore the responsibility, features and authority of three major governmental sectors - the legislative, the judicial and the executive. In addition, self-regulation, an alternative initiated by the insurance industry to prevent itself from public intervenes, is also envisaged. With respect to the current regulatory structure in Taiwan, this paper submits certain comments and suggestions in the final part for the future of insurance regulatory reform in Taiwan.
