自危險核保與理賠觀點論ICC, 2009之保險期間A Study on Institute Cargo Clauses 2009 from the Viewpoints of Risk

摘要
　　本文以最新2009年英國協會貨物保險條款(Institute Cargo Clause, 2009；以下簡稱ICC, 2009)有關保險期間之規定為研究基礎，逐條分析第8條航程條款、第9條運送契約終止條款以及第10條之變更航程條款，再分別自保險人之核保與理賠角度探討ICC, 2009之影響與因應。研究結果發現保險期間規定最大改變在第8條，即於8.1款中將保單生效之「動作」提前到倉庫內為了將保險標的裝載於運送工具為目的地之第一次移動開始，並於8.1.1中擴大保險人之保險期間至保險標的卸貨完成時終止，並於第10條增列了變更航程之規定，本文並對危險核保及理賠觀點提出建議。

Abstract
　　This study from viewpoints of the underwriting and claim discusses the Transit Clause, Termination of Contract of Carriage Clause and Change of Voyage Clause at Institute Cargo Clause, 2009. This study finds that changes in article 8 the most largely, and according clause 8.1, the insurance attaches from the time the goods is first moved in the warehouse, and the insurance terminate on completion of unloading and has arranged the regulation of change of voyage again in article 10. This study also combines and proposes the suggestion on the underwriting and claim.
