台灣高鐵旅客運送責任制度之研究Study on the Carriers Liability System of Taiwan High Speed Rail

摘要
本文藉由目前國際海運及空運公約、日本高速鐵路，及國內高速鐵路以外之其他運具的旅客運送人之損害賠償責任，及責任保險的特性之探討，釐清政府、高鐵公司及旅客三者在高鐵運輸中之權利與義務，並提出高鐵責任保險制度之原則。最後針對政府、高鐵公司及旅客三方，提出建議。
欲保障旅客的權益及降低高鐵之營運風險，身為高鐵公司之主管機關的交通部，應盡主管機關協助管理高鐵業務及監督把關之責，儘速建立高鐵公司旅客運送法規，成立高鐵運送人責任保險，以為高鐵風險移轉的基礎，降低高鐵的營運風險。在意外事故發生後，讓受害者或受害者的家屬，迅速獲得賠償，以減少社會的不安。

Abstract
This research clarifies the rights and obligations among government, Taiwan High Speed Rail, and passengers by investigating the carrier’s liability for passengers of international Convention, national law, Japan’s law, and the property of carrier’s liability insurance of conveyance in Taiwan. Furthermore, this study suggests that the foundation of Taiwan High Speed Rail carrier’s liability insurance system. Finally, this study advances several recommendations to government, Taiwan High Speed Rail, and passengers of Taiwan High Speed Rail.
This study proposes the Ministry of Transportation and Communication has to set up the law for Taiwan High Speed Rail and establish passenger’s liability insurance as soon as possible to protect passenger’s due, lower Taiwan High Speed Rail operation risk, and let the sufferers of accident could receive compensations briskly to lessen agitation in society after High Speed Rail accident occurs.
